Brazil is determined to reduce the process to register patents

Dear colleagues, we inform you that starting from July 9th 2019, the National Institute of Intellectual Property of Brazil (INPI BR) has published the resolutions 240/19 and 241/19, both of which have already gone into effect.
Both norms are intended to contribute to reduce the time it takes to process a patent registration, since in the last two years 160,000 applications have remained unsolved.
According to the publication of the Intellectual Property Gazette, the so-called “Previous report” has passed on to rename itself as Preliminary Official Actions, as established in the codes 621 and 622, the Brazilian examiners will be able to use searches previously carried out in similar cases and that already have a report issued.
Among the preliminary official actions included in code 621, are the applications with reports issued by other patent offices, previous examinations and that have not been initiated by the INPI, not having an accelerated procedure in progress or observations made by ANVISA or a third party.
As for the code 622, it is totally focused on the state of art, the same of which should not have started any search in another patent office outside of Brazil, which will be assumed by the Brazilian examiner in order to allow the process to continue.
